ARCOS provides customized Work Health and Safety (WHS) documentation services for Australian construction contractors. Our services include:

• Collection of business information via questionnaire
• Review and analysis of your WHS requirements
• Creation of customized WHS documentation including:
  • WHS Policy Statement
  • Risk Assessment Register
  • Safe Work Method Statements (SWMS)
  • Emergency Procedures
  • Incident/Injury Register
  • Worker Induction Program

2. How Our Service Works

Step 1: Questionnaire

You complete our online questionnaire providing details about your business, work activities, hazards, and compliance requirements. Completion of the questionnaire does not create any obligation or contract.

Step 2: Review and Quote

We review your questionnaire responses and contact you within 7-10 days to clarify details, explain what documentation you need, and provide a fixed-price quote.

Step 3: Agreement and Payment

If you accept our quote, we will send you an invoice. The contract is formed when you make payment. No work begins until payment is received.

Step 4: Document Creation

We create your customized WHS documentation based on the information you provided. This typically takes 7-10 business days from receipt of payment.

Step 5: Delivery

We deliver your completed documents via email as PDF files. You may request one round of minor revisions within 14 days of delivery at no additional charge.

3. Pricing and Payment

• All prices are quoted in Australian Dollars (AUD) and include GST where applicable
• Prices are fixed and agreed upon before work begins
• Payment must be made in full before document creation begins
• We accept payment via bank transfer, credit card, or other methods as specified
• Payment terms are due immediately unless otherwise agreed in writing

4. What You're Getting

Document Templates

The documents we provide are customized templates based on the information you supply. These documents are designed to help you comply with Australian WHS legislation and demonstrate due diligence.

Not Legal Advice

We are not lawyers. The documents we provide are not legal advice. While our documents are based on WHS best practices and Australian regulations, we cannot guarantee that they will meet all specific requirements of your business or provide complete legal protection.

Your Responsibility

You are responsible for:

• Providing accurate and complete information in the questionnaire
• Reviewing the documents we provide
• Implementing the procedures outlined in the documents
• Keeping the documents up to date as your business changes
• Seeking independent legal advice if required

5. Accuracy of Information

You warrant that:

• All information you provide is true, accurate, and complete
• You have authority to provide this information
• You will notify us immediately if any information changes before delivery

We are not responsible for errors or omissions in the final documents that result from inaccurate or incomplete information provided by you.

6. Intellectual Property

Your Documents

Once you have paid in full, you own the documents we create for your business. You may use, modify, copy, and distribute them for your business purposes.

Our Templates and Methods

We retain all intellectual property rights in our templates, methodologies, questionnaires, and processes. You may not resell, redistribute, or use our templates to create documents for other businesses.

7. Revisions and Changes

We include one round of minor revisions within 14 days of initial delivery at no additional charge. Minor revisions include correcting errors we made, updating information you provided, and minor formatting changes.

Major revisions (substantial changes to scope, new SWMS, significant restructuring) may incur additional charges, which will be quoted separately.

8. Refund Policy

Before Document Creation: If you cancel before we begin creating your documents (before payment), there is no charge.

After Payment, Before Delivery: If you cancel after payment but before delivery, we will provide a 50% refund.

After Delivery: Once documents are delivered, all sales are final. We do not provide refunds after delivery, but we will work with you through our revision process.

9. Limitation of Liability

We Are Not Liable For:

• Any injuries, incidents, or accidents that occur in your workplace
• Fines or penalties imposed by regulatory authorities
• Legal claims or litigation arising from workplace incidents
• Any indirect, consequential, or special damages
• Loss of business, revenue, or profits

Maximum Liability: Our total liability to you for any claim shall not exceed the amount you paid for our services.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Australia.
